Terms and Conditions of Sale

These General Terms and Conditions of Sale (TCS) govern the contractual relationship between Brand Success (SIRET: 833 537 665 00022 — 78 avenue des Champs-Élysées, office 562, 75008 Paris, France), publisher of the Kollex platform, and any user of the paid services offered: the Premium subscription and the publication of marketplace listings.

Premium Subscription: access to advanced features (unlimited items, multiple collections, insurance PDF export, advanced statistics).

Marketplace: the ability for users to publish sale listings for items in their collections. In the event of a sale completed via the marketplace, Kollex receives an 8% commission on the sale price.

Current rates are as follows:

• Monthly Premium Subscription: €9.99 / month
• Annual Premium Subscription: €89 / year
• Marketplace listing publication: free. An 8% commission on the sale price is collected by Kollex upon completed sale.

Kollex reserves the right to modify its prices at any time, with new prices applying to new orders.

Payments are secure and processed by our provider Stripe. Kollex does not have access to your banking information. Payments are made in euros by credit card.

In the event of a sale completed via the marketplace, Kollex receives an 8% commission calculated on the sale price of the item. This commission is indicated to the seller at the time of listing creation. The balance is paid to the seller according to the agreed terms.

The Premium subscription is taken out for the chosen duration (monthly or annual) and is automatically renewed at expiry unless you deactivate it from your settings.

You can cancel automatic renewal at any time. The subscription remains active until the end of the paid period.

In accordance with applicable legislation, you have a 14-day period to exercise your right of withdrawal on a subscription, starting from the date of subscription. This right does not apply to services fully performed with your explicit consent before the end of the period.

Kollex acts as a technical intermediary for the marketplace and does not participate in the transaction between buyer and seller. Kollex cannot be held responsible for disputes relating to items sold (conformity, condition, delivery). It is up to the parties to settle their transactions directly.

Kollex cannot be held responsible for failures due to a case of force majeure within the meaning of established case law.

These TCS are subject to French law. In the event of a dispute, the parties shall endeavor to find an amicable solution. Failing that, the French courts shall have jurisdiction.
